By downloading, installing, or using CleanShot ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.

These Terms apply to all users, including trial users and paid subscribers.

CleanShot provides road condition and weather hazard advisory information for commercial truck drivers. The Software aggregates data from public weather services, state DOT/511 feeds, and community reports to provide situational awareness on the road.

⚠ CleanShot provides advisory information only. Road conditions can change rapidly and without notice. Never rely solely on CleanShot for safety-critical decisions. Always follow official road signs, DOT closures, law enforcement instructions, and your own professional judgment. CleanShotHQ LLC is not liable for accidents, injuries, delays, fines, or damages of any kind resulting from use of or reliance on CleanShot data.

Data sources include third-party feeds that may be delayed, incomplete, or inaccurate. CleanShot makes no warranty about the accuracy, timeliness, or completeness of any road condition data.

4. HOS Advisory — Not an ELD

⚠ The Hours of Service (HOS) Guardian feature provides advisory tracking only. It is NOT a certified Electronic Logging Device (ELD) under FMCSA regulations (49 CFR Part 395). Do not use CleanShot as your primary HOS compliance tool. You are legally required to use a certified ELD for regulatory compliance. CleanShotHQ LLC accepts no responsibility for FMCSA violations arising from reliance on the HOS Guardian feature.

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEANSHOTHQ LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT DATA WILL BE ACCURATE OR COMPLETE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLEANSHOTHQ LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SOFTWARE. OUR TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved exclusively in the courts of Salem County, New Jersey. You consent to personal jurisdiction in those courts.

13. Changes to These Terms

We will notify active subscribers at least 30 days before making material changes to these Terms. Notification will be sent to your registered email address. Your continued use of CleanShot after the effective date of changes constitutes acceptance of the updated Terms.

For non-material changes (typos, formatting, clarifications), we may update without prior notice.

14. Termination

We may suspend or terminate your access if you violate these Terms. You may cancel your subscription and stop using CleanShot at any time. Upon termination, your license ends immediately. Sections 3, 4, 9, 10, 11, and 12 survive termination.
