Terms of Service — CleanShot HQ

Plain English summary: CleanShot is a road intelligence advisory tool for truck drivers. It is not an ELD, not a GPS navigator, and not a substitute for your professional judgment. Use it as one of many inputs, not your only one.

1. Acceptance of Terms

By downloading, installing, or using CleanShot ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.

These Terms apply to all users, including trial users and paid subscribers.

2. Description of Service

CleanShot provides road condition and weather hazard advisory information for commercial truck drivers. The Software aggregates data from public weather services, state DOT/511 feeds, and community reports to provide situational awareness on the road.

CleanShot is not a replacement for:

Professional driver judgment
Official road signs and DOT instructions
Certified Electronic Logging Devices (ELDs)
Real-time navigation systems
Emergency services

3. Critical Safety Disclaimer

⚠ CleanShot provides advisory information only. Road conditions can change rapidly and without notice. Never rely solely on CleanShot for safety-critical decisions. Always follow official road signs, DOT closures, law enforcement instructions, and your own professional judgment. CleanShotHQ LLC is not liable for accidents, injuries, delays, fines, or damages of any kind resulting from use of or reliance on CleanShot data.

Data sources include third-party feeds that may be delayed, incomplete, or inaccurate. CleanShot makes no warranty about the accuracy, timeliness, or completeness of any road condition data.

4. HOS Advisory — Not an ELD

⚠ The Hours of Service (HOS) Guardian feature provides advisory tracking only. It is NOT a certified Electronic Logging Device (ELD) under FMCSA regulations (49 CFR Part 395). Do not use CleanShot as your primary HOS compliance tool. You are legally required to use a certified ELD for regulatory compliance. CleanShotHQ LLC accepts no responsibility for FMCSA violations arising from reliance on the HOS Guardian feature.

5. Subscription and Billing

Subscriptions renew automatically at the end of each billing period (monthly or annually)
The 30-day free trial includes full feature access — no charge until day 31
Cancel anytime by emailing [email protected] or through your account dashboard
Annual subscriptions cancelled within 30 days of renewal receive a prorated refund for unused time
Monthly subscriptions are non-refundable but cancel immediately upon request
Founding Member rate ($4.99/month) is locked for life as long as the subscription remains active without interruption
If pricing changes, existing subscribers receive 90 days' notice and are grandfathered at their current rate

6. License Grant

Subject to these Terms, CleanShotHQ LLC grants you a personal, non-exclusive, non-transferable, revocable license to install and use CleanShot for your own commercial trucking operations.

You may not:

Redistribute, resell, or sublicense the Software
Reverse engineer, decompile, or disassemble the Software
Share your license key with others or use it on behalf of a fleet without a fleet subscription
Remove or alter any copyright or trademark notices

7. Acceptable Use

Do not interact with CleanShot while actively driving. Use voice alerts (TTS) when the vehicle is in motion.
Do not attempt to circumvent license verification or trial limitations
Do not use automated tools to query CleanShot data in bulk
Do not use CleanShot for any illegal purpose

8. Data and Privacy

Your use of CleanShot is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Intellectual Property

CleanShot, CleanShot HQ, and the associated truck logo are trademarks of CleanShotHQ LLC (trademark registration pending). All source code, documentation, and website content are copyright © 2026 CleanShotHQ LLC. All rights reserved.

The underlying source code is available on GitHub under its own license terms.

10. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEANSHOTHQ LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT DATA WILL BE ACCURATE OR COMPLETE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLEANSHOTHQ LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SOFTWARE. OUR TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved exclusively in the courts of Salem County, New Jersey. You consent to personal jurisdiction in those courts.

13. Changes to These Terms

We will notify active subscribers at least 30 days before making material changes to these Terms. Notification will be sent to your registered email address. Your continued use of CleanShot after the effective date of changes constitutes acceptance of the updated Terms.

For non-material changes (typos, formatting, clarifications), we may update without prior notice.

14. Termination

We may suspend or terminate your access if you violate these Terms. You may cancel your subscription and stop using CleanShot at any time. Upon termination, your license ends immediately. Sections 3, 4, 9, 10, 11, and 12 survive termination.
